SC notices to Chief Secretary, IG Punjab on PTI's plea for a level playing fieldBreaking

January 03, 2024

A 3-member bench of Supreme Court of Pakistan (SCP) headed by Chief Justice Qazi Faiz Isa, Justice Muhammad Ali Mazhar, and Justice Musrat Hilali, addressed the petition filed by the Pakistan Tehreek-e-Insaf (PTI) concerning a level playing field. PTI's lawyers, Latif Khosa and Shoaib Shaheen, appeared before the court during the proceedings. Chief Justice Isa expressed his dissatisfaction with the use of the title "Sardar" by Latif Khosa, stating that the "Sardari system has ended." Khosa clarified that it was an error made by a stenographer and assured caution in the future. During the hearing, Khosa argued that a level playing field is essential for healthy competition. Justice Muhammad Ali Mazhar questioned whether PTI had approached the Election Commission on the Supreme Court's order. The Chief Justice inquired about PTI's specific request, emphasizing that it was a contempt of court request related to a previous case dealt with on December 22. Justice Mazhar pressed Khosa on the inclusion of individuals who had insulted the court in the application.

The Chief Justice sought clarification on the Election Commission's stance and whether they had issued any orders. Khosa claimed that no orders had been given by the Election Commission, prompting Justice Mazhar to inquire about evidence. Khosa mentioned obstacles faced by PTI candidates, to which the Chief Justice urged presenting evidence. The court suggested filing a separate application for individual actions against those affected. Khosa highlighted challenges in obtaining appeal orders promptly. The Chief Justice emphasized that the court could not take over the Election Commission's role. Khosa was urged to review the Election Commission's detailed implementation report submitted on December 26. The court issued a notice to the Chief Secretary and IG Punjab, seeking their response on PTI's plea for a level playing field. The hearing was adjourned until January 8, Monday.
