The Lahore High Court on Wednesday declared physical remand null and void for not preparing documents according to rules and regulations and ordered registration of a case against police officials. Justice Tariq Nadeem, in his nine-page written decision, ordered registration of a case against Bahawalpur DPO, SHOs and investigating officer within five days for failure to follow rules while seeking physical remand of a suspect.Justice Nadeem ruled that the police must write serial number and FIR number on the last page of a supplementary note while applying for physical remand of a suspect.
He observed that the case diary against an accused must be duly registered in daily register with signature of the SHO concerned along with serial number on the FIR.Justice Nadeem observed that papers seeking physical remand must be prepared according to instructions written in police rules. He issued orders to police, anti-corruption department, and FIA to follow laid down principles while moving a court for physical remand of an accused.
