Information Secretary of Pakistan Justice & Democratic Party (PJDP) M. Badar ud Duja has said that appointment of Chief Justice of Pakistan (CJP) shouldn’t be subjected to seniority but according to neutrality and judgment records not violating court jurisdiction & constitution of Pakistan. In a statement issued on Monday, he pointed out that judiciary needs colossal reforms as current system has lost its credibility, effectiveness & quality of justice within people of Pakistan. He said that it’s disturbing that in World Judicial Ranking Pakistan has been marked at 130th out of 142 countries. Badar ud Duja said that a new superior to SC body ‘Constitutional Court’ could be established under Senate to assist Parliament in constitutional matters and interpretations of constitutional laws, Suo moto permission to SC, review of SC decisions of national & public interests.
He said that the Supreme Judicial Council should be brought under Senate of Pakistan where Judges of council will be appointed by Senate judicial committee & Senate members voting independently in order to bring more transparency & impartiality. The Secretary Information PJDP noted that a country’s outlook directly related to judiciary performance and trust of people, meanwhile incumbent government was about to make short term decisions in its own interests as practiced in previous political tenures which have less implication toward building trust & coordination between institutions. Badar ud Duja said that friction between government and institutions always play negative in national-regional strategies & economic-financial development. So Pakistan needs long term institutional reforms out of any selective approach and political pressure or will, he added.
